Plffs Father and Mother, both age 39, were traveling with their minor songs, ages 14 and 15, on Hwy 3 near St. Maries, Idaho. Plffs contended the Def. crossed over the center line and struck their vehicle, resulting in a significant impact collision. At the time of the collision, the Def. was driving under the influence of alcohol. Injuries: Plff Father: shoulder injury; torn ligaments (non-surgical). Neck strain. Plff Mother: traumatic brain injury resulting in cognitive loss; Post Traumatic Stress Disorder (PTSD). Abdominal, knee, and back pain. Plff Minor 1: traumatic brain injury, concussion. Plff Minor 2: cervical and lumbar strains.

Specials:

Med. $8,041 for Plff Father, $20,178 for Plff. Mother, $8,911 for Plff Minor 1 and $4,508 for Plff Minor 2; Lost Wages - Plff Mother ultimately lost her job due to inability to perform her work tasks.

Settlement:

Demand: $50,000 3rd party and $250,000 UIM (policy limits). Offer: $50,000 3rd party and $250,000 UIM (policy limits).

Result:

PLAINTIFF SETTLEMENT for $300,000. (The settlement included $85,000 each for Plff Parents, $100,000 for Plff Minor 1, and $30,000 for Plff Minor 2.)
